These terms are the agreement between you and Nearviews.com (“Nearviews”, “we”, “us”) for using our website and services. Please read them together with our Privacy Policy. By creating an account or using Nearviews you agree to them.
1. Accepting these terms
If you do not agree with these terms or the Privacy Policy, do not use Nearviews. Signing up, logging in (including with Google) or otherwise using the service means you accept both documents.
2. What Nearviews is
Nearviews is a microblogging site. Members post short public text, photo and video “Views” that are tagged with where they were posted, and see Views from people within a radius they choose. They can also like, comment, re-view, follow and send direct messages. Because content is published to other people, it is not private.
3. Who can use it
You must be at least 13 years old, or older if your country requires a higher age, and able to form a binding agreement. If you use Nearviews on behalf of an organisation, you confirm you may bind it.
4. Your account
Give accurate information and keep it up to date. One person should hold one account, and you may not impersonate anyone.
You are responsible for everything done through your account. Keep your password and your Google account secure, and log out on shared devices.
Tell us right away if you suspect unauthorised use. We are not responsible for losses caused by someone using your account because of your failure to protect your credentials.
5. Your data, your responsibility
Nearviews is public by design. It is your responsibility to protect your own personal information. Do not post or send your home address, phone number, personal email, government ID numbers, payment or banking details, passwords or codes, medical or other sensitive information, private details about other people, or anything that shows when you are away or exactly where you will be. Remember that Views and comments carry location data, and photos can carry hidden metadata.
Anything you share can be seen, copied and re-shared by others, and may remain available after you delete it. By posting, you accept that risk. Read our Privacy Policy for the full explanation.
6. Location
Nearviews requires your device location to be on. It reads your GPS while you use the app, saves your latest coordinates and city on your profile (refreshed about every 15 minutes), and tags your Views and comments with them.
Do not fake, spoof or hide your location to mislead others or to get around the service.
Other users can see the city and distance, and the coordinates behind them, for your Views, comments and profile.
7. Your content
You keep ownership of what you post. You give Nearviews a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute your content on and through the service, so we can run it. This licence ends when you delete the content or your account, except for copies that other users have shared, and backups or logs that remain for a limited time.
You confirm you own or have permission to post what you upload, and that it does not infringe anyone's rights or break the law. You are solely responsible for your content and for any consequences of posting it.
8. Acceptable use
You agree not to:
post unlawful, threatening, harassing, hateful, sexually explicit or violent content, or content that exploits or endangers children;
publish other people's private information (doxxing), or track, stalk or locate someone against their wishes;
spam, scam, impersonate others, or mislead people about who you are or where you are;
upload malware, scrape the service, probe or attack it, or work around its limits and security;
use Nearviews for anything illegal or that harms other people or the service.
9. Removal and suspension
We may remove content, limit features, or suspend or end accounts at our discretion, for example for breaking these terms, to protect people, or to follow the law. We are not obliged to monitor content, and we do not endorse what members post. You can report problems to us at [email protected].
10. Third-party services
Nearviews works with services we do not control, such as Google sign-in, map and geocoding providers, hosting and YouTube embeds. Their own terms and privacy policies apply, and we are not responsible for them or for their failures.
11. No warranties
Nearviews is provided “as is” and “as available”. To the maximum extent permitted by law we make no promise that it will be uninterrupted, secure or error-free, that locations or distances are accurate, or that content will always be available. We do not guarantee that any information will be kept safe from loss or unauthorised access.
12. Limitation of liability
To the maximum extent permitted by applicable law, Nearviews.com and its owners, operators and partners are not liable for any loss, deletion, corruption, disclosure or leak of data, including personal information you or others post, or that is exposed through your devices, passwords or accounts, copied or re-shared by other users, or lost through a failure of a third-party service. We are also not liable for indirect, incidental, special or consequential damages, loss of profits, goodwill or content, or for anything that happens between users, online or in person, including meeting people you find through Nearviews.
Where the law does not allow a limit to apply, our total liability is limited to the smallest amount the law permits. Nothing here excludes liability that cannot lawfully be excluded, such as for fraud or intentional wrongdoing.
13. Indemnity
You agree to defend and compensate Nearviews.com and its operators against claims, losses and costs that arise from your content, your use of the service, or your breach of these terms or of someone else's rights, to the extent permitted by law.
14. Changes and ending your use
We may change the service or these terms from time to time. The date at the top shows the latest version, and continuing to use Nearviews after a change means you accept it. You may stop using Nearviews at any time: you can hibernate your account (hidden until you log in again) or permanently delete it from Settings on your profile. Deleting is final and cannot be undone. We may suspend or end the service or your access at any time.
15. General
These terms, with the Privacy Policy, are the whole agreement between you and us about Nearviews. If a part is found unenforceable, the rest still applies. Not enforcing a term is not a waiver of it. They are governed by the laws of the place where the Nearviews.com operator is established, without regard to conflict-of-law rules, and disputes belong in the courts there, unless mandatory local consumer law gives you other rights.
